These Terms of Use (the "Terms") govern your use of the CyberChamp Academy websites and mobile applications owned or operated by CyberChamp Academy and resources offered by  CyberChamp Academy on the Site, on mobile devices, or through social media platforms (all of which are collectively referred to as the "CyberChamp Academy Service" or "Service") – as well as your participation in the CyberChamp Academy programs offered through the Service.

Please read these Terms carefully. By clicking "I accept the terms of the User Agreement" and "Start Learning," you affirm that you have read and understand, and agree to be bound by, these Terms. If you do not agree to these Terms, you should not use the CyberChamp Academy Service.

Certain Service portions may be subject to additional terms and conditions ("Additional Terms"). Where Additional Terms apply, we will make them available for you to read through your use of that portion of the Service. By clicking "I accept the terms of the User Agreement" and "Start Learning," you agree to be bound by the Additional Terms.

1. The CyberChamp Academy Service

The  CyberChamp Academy Service comprises advanced professional training programs offered by Practicum ("Programs"). Upon successful completion of a Program, as determined by CyberChamp Academy, you will receive a certificate of completion if requested (a "Certificate") (if you do not complete a course, you may be entitled to receive a certificate of attendance).

You understand and acknowledge the following:

  • THE CYBERCHAMP ACADEMY PROGRAMS ARE NOT ACCREDITED. CyberChamp Academy is not accredited and does not confer formal degrees, and a Certificate is not a traditional degree.

  • YOU WILL NOT RECEIVE ACADEMIC CREDIT FOR YOUR COMPLETION OF A PROGRAM. A Certificate will not entitle you to academic credit recognized by any other institution.

  • COMPLETION OF A PROGRAM IS NOT A GUARANTEE OF FUTURE EMPLOYMENT OR ADVANCEMENT. While completing a CyberChamp Academy Service program will enhance your knowledge base and skill set and make you a more well-rounded employee or employment candidate, we cannot and cannot make any representations regarding your future employment or advancement.

  • YOUR WORK MUST BE YOUR OWN. The work you perform and submit (e.g., homework assignments, quizzes, exams, and projects will be your work (except if you are permitted to work with others).

  • YOU MAY NOT SHARE YOUR WORK WITH OTHERS. You will not share your work with anyone else or perform work for others (except if you are expressly permitted to share or collaborate).

  • NO CHEATING. You will not engage in dishonest or improper conduct to improve your results or affect the results of other students.

 

Your Responsibilities

To participate in the Program, you must register. When you register, CyberChamp Academy collects certain personal information about you. You agree that  CyberChamp Academy may use information CyberChamp Academy obtains about you by the provisions of Practicum's Privacy Policy. You also agree that the information you provide at registration and any time following registration will be true, accurate, and complete. You will update such information to remain up-to-date and accurate at all times.

To access the Service, you must sign up as a new CyberChamp Academy user via the Site. Upon registration, you shall provide valid information requested in the registration form and shall update such information if necessary. CyberChamp Academy shall reserve the right to require you to verify the information provided upon registration and request supporting documents at any time. CyberChamp Academy reserves the right to deny your access to the account if provided report fails to conform to the information provided upon registration.

You may be asked to select a username and password for the registration process. CyberChamp Academy may refuse to grant you a username or revoke your username for any reason in its sole discretion, including if we determine that such username impersonates someone else, is illegal, vulgar, or otherwise offensive, or is protected by trademark or other proprietary rights law, or otherwise may cause confusion. You will be responsible for the confidentiality and use of your username and password and agree not to transfer or resell your use of or access to the Service to any third party.


We value the integrity of the CyberChamp Academy community. To protect this community, you agree not to use the CyberChamp Academy Service to:

  • Violate any local, state, national or international law or regulation

  • Transmit any abusive material, harassing, tortious, defamatory, vulgar, pornographic, obscene, libelous, invasive of another's privacy, hateful or racially, ethnically, or otherwise objectionable

  • Stalk, harass, bully, or harm another individual

  • Transmit any unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes, or any other form of solicitation

  • Knowingly transmit any material containing adware, malware, spyware, software viruses, or any other computer code, files, or programs designed to interrupt, destroy or limit the functionality of any computer software, hardware, or telecommunications equipment.

  • Defeat or interfere with any security feature of the CyberChamp Academy Service, or attempt to do so

  • Impersonate any person or entity, or otherwise misrepresent your affiliation with a person or entity

  • Interfere with or disrupt the CyberChamp Academy Service or servers or networks connected to the CyberChamp Academy Service, or disobey any requirements, procedures, policies, or regulations of networks connected to the CyberChamp Academy Service; or

  • Alter or modify any content or component of the CyberChamp Academy Service other than your User Content (as defined below).

You also agree not to use or launch any automated system, including, without limitation, "robots," "spiders," "offline readers," or the like, that access the CyberChamp Academy Service.

Fees and Payment, Refunds, Suspension

Payment. You will be responsible for paying the then-current tuition fees for the Programs you take.

You will pay the applicable tuition fees in advance using payment mechanisms we may make available. All charges and payments shall be in U.S. Dollars unless otherwise agreed by CyberChamp Academy.

You may pay your tuition fee fully in advance or opt for recurring monthly payments. By selecting regular monthly payments, you expressly authorize CyberChamp Academy to automatically charge the applicable standard monthly fee to Your payment method. Your first monthly payment will be charged to your payment method upon purchase date, and your second monthly payment will be charged to your payment method 26 days from the Program start date. For each subsequent month, the monthly fee will automatically be charged within 30 calendar days following your previous payment date.

Tuition excludes all taxes, fees, duties, and governmental assessments (except for taxes based on CyberChamp Academy's net income) that may be imposed or become due in connection with your use of the Service ("Taxes"), and you are responsible for payment of any such Taxes.

Cancellation. You may cancel your participation in the program not more than 4 weeks into the gram.  You must  complete and submit  the CyberChamp Academy Refund Survey (the "Survey")

Please note that the refund as outlined in this Section, if there is any, will be issued within 30 days following your submission of the Survey. If you are eligible for the refund, your refund will be sent back to the original form of payment used.

No refund will be available if you stay beyond four weeks, complete the Program, obtain a Certificate, or request a refund more than one year after the date you first paid for the Program.

Money-Back Guarantee. Suppose you enroll in a Program under a money-back guarantee of employment or promotion. In that case, you may receive your money back if you fail to find a new job or obtain advertising within your current organization is subject to all the following conditions:

  • You must have initially indicated upon enrollment that you are looking for a new job or a promotion from your current job

  • You must have completed the Program You are enrolled in (100% of the Program Curriculum)

  • You must be 21 years of age or older, legally permitted to work in the United States, and seeking employment or promotion with a U.S. employer

  • You must have evidence of the following:

    • Career Prep Course;

    • Project work completion

    • Mock interviews;

  • You must declare your job search start date on your career page within 30 days of joining the career acceleration program.

  • You must attend a one-on-one meeting with your coach at least once every two weeks or as indicated by the career team and complete all the tasks assigned by your career coach — including, but not limited to, regularly applying for jobs, networking, and working on portfolio projects.

  • You must maintain precise records of your job search activities and demonstrate at CyberChamp Academy that you consistently sought a new job for at least 12 months following the start date but could not obtain a qualifying job offer.   Qualifying job offer means a paid onsite or remote full-time (anticipated to be an average of 30 hours or more per week) job offer for a position as an employee, apprentice, intern, or independent contractor relevant to the field of study and anticipated to be at least four weeks in duration.

Career Support Program, and the Money-Back Guarantee, immediately terminates upon acceptance of the qualifying job offer.
If your Qualifying Job Offers are revoked due to an employee-initiated drug test or background check, you will not be eligible for any tuition waiver or Money-Back Guarantee.

Suspension. We may suspend your participation in the Program under the following circumstances: (a) if you fail to show up in class for two consecutive weeks or longer; (b) if you fail to pay your tuition fees or we are unable to process your payment; (c) if you breach these Terms; or (d) if you fail the program deadlines for submitting tasks or projects. Your Suspension will last until the complete elimination of the reason or circumstances causing such Suspension.

Please note that your access to the Program will be closed during the Suspension.

You acknowledge and agree that your Suspension should not exceed three months. You accept and agree that your failure to eliminate the reasons for your Suspension following the three-month suspension period, as well as your failure to meet the Program deadlines following suspension time terminates your right to complete the Program, and your access to the Program is to be canceled without any request for a refund, discount or offset. In that case, your return to the studies requires new enrollment into the Program, if allowed.

 

 Feedback

You agree that CyberChamp Academy and its affiliates are free to use for any purpose whatsoever, ideas, know-how, concepts, techniques, comments, criticisms, reports, or other Feedback (collectively, "Feedback") that you may voice about the Service, including Feedback that you send to CyberChamp Academy or its affiliates. You acknowledge and agree that you have no expectation of compensation or confidentiality of any nature and that  CyberChamp Academy has no duties to you (including any obligation to compensate you for your Feedback) concerning such Feedback.

 Modifications to Service

CyberChamp Academy reserves the right to modify or discontinue the CyberChamp Academy Service with or without notice to you, including the right to cancel, interrupt, or reschedule any Program or to change any course content or requirements. CyberChamp Academy shall not be liable to you should Practicum exercise its right to modify or discontinue the CyberChamp Academy Service.

The CyberChamp Service may contain links to third-party websites and other Internet resources not owned or controlled by CyberChamp Academy ("Third-Party Materials"). The Practicum's provision of a link to any Third Party Materials is for your convenience only. It does not signify CyberChamp Academy's endorsement of another website or resource or its contents.

 

 Disclaimer of Warranties

YOU USE THE PRACTICUM SERVICE AT YOUR SOLE RISK. THE CYBERCHAMP ACADEMY SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, CYBERCHAMP AND ITS AFFILIATES EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, CONCERNING THE CYBERCHAMP ACADEMY SERVICE (INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR USE OR PURPOSE AND NON-INFRINGEMENT).
